Summary:
The attached ordinance amends the City Code provisions pertaining to the use of permits and licenses by the CEO of Utilities granting permission for the use of Utilities-controlled property.
Background:
The proposed ordinance amends City Code Chapter 12 (Utilities). This amendment will authorize the CEO to issue licenses for the use of Utilities-controlled property and will clarify that permits are only used by Utilities for specialized Utilities-controlled property, such as watersheds and poles. Currently, the Code authorizes the CEO to issue permits for use of all Utilities-controlled property, but that is inconsistent with Utilities' current practice which is to issue licenses for the use of non-specialized property.
Previous Council Action:
City Council amended the City's Real Estate Manual in March of 2021 to manage City Real Estate, including provisions for acquisitions, dispositions and resolving title issues.
The proposed ordinance was reviewed at Utilities Board on November 20, 2024.
