Summary:
The proposed resolution would authorize the use of Possession and Use Agreements and/or Eminent Domain to acquire easements ("Easements") from Harman Management Corp and KW 1502 LLC (collectively the "Property Owners") needed in connection with the I-25 Ramps/Nevada Tejon Corridor Improvements Project (the "Project").

Background:
The Project was identified by the Pikes Peak Rural Transportation Authority ("PPRTA") as an "A-list" priority project. The Project is intended to improve reoccurring traffic incidents, conflicts, and congestion during peak weekday and weekend travel times that are currently experienced at the intersections of the I-25 ramps and S. Nevada Ave and S. Tejon St.

The Easements to be acquired will allow for the construction of sidewalks, driveways, and Americans with Disabilities Act (ADA) ramps to improve pedestrian movements in the Project area. (see Location Map for Project location). Project construction began in May 2024 and is expected to be completed in June 2025.

Negotiations with two Property Owners with respect to the required easements are at an impasse.

Staff requests that City Council approve the Resolution to acquire the easements through the use of Possession and Use Agreements and/or Eminent Domain. The attached Resolution authorizes the City Attorney to take all necessary action to acquire the Easements. In all cases, the Property Owners will be compensated for the Easements needed for the Project.
