Summary:
This ordinance clarifies the role of the Airport Advisory Commission (AAC) as it relates to activities within the industrial/business park on Municipal Airport-controlled property (the "business park").

Background:
With the organizational reassignment of economic development responsibilities for activities within the business park from the Aviation Director to the Chief of Staff, the Chief of Staff asked the City Attorney's Office to review the City Code provisions pertaining to the advisory role of the Airport Advisory Commission as it relates to the business park. The City Code currently provides that the AAC shall act in an advisory capacity on matters concerning land use and all other matters affecting the construction, planning or operation of the Airport. Advice includes issues related to the airport master plan and long-range planning for the airport.

Construction, planning, and operation of a business park was not a consideration when the AAC ordinance was initially adopted in 1965. These business park activities are independent of construction, planning, and operation of the Airport itself. To the extent industrial park construction, planning, and operation does affect or impact the construction, planning, or operation of the Airport, the AAC's advisory responsibility flows to the impact the industrial park activities may have on Airport construction, planning, and operation, not on whether the industrial park proposal is appropriate.
