A Resolution Approving an Intergovernmental Agreement between the City of Colorado Springs and the Pikes Peak Area Council of Governments (PPACG) in Support of the Specialized Transportation Program

  Summary:

The City of Colorado Springs was the designated recipient for federal Section 5310 - “Enhanced Mobility for Seniors and People with Disabilities” - funds for the Colorado Springs Urbanized Area from 2013 through 2020.  In 2021, the Pikes Peak Area Council of Governments (PPACG) became the designated recipient, and to ensure a smooth transition, the City entered into an Intergovernmental Agreement (IGA) with PPACG to provide annual operating funds from its Pikes Peak Rural Transportation Authority (PPRTA) allocation if PPACG agreed to report trip data to the National Transit Database (NTD).  PPACG and the City have since discovered that certain requirements in the original IGA are impossible to fulfill and have drafted a new IGA to address the issues.  

 

  Background: 

On January 12, 2021, City Council approved Resolution 03-21.  The Resolution approved and authorized an Intergovernmental Agreement (IGA) between the City and the Pikes Peak Area Council of Governments (PPACG) to transfer administration of the Specialized Transportation Program from the City to PPACG. 

That IGA contained a requirement that PPACG apply for a National Transit Database (NTD) identification and report Specialized Transportation operating and asset data beginning January 1, 2021.  The IGA also provided for a base level of funding support each year from the City of Colorado Springs and the potential for additional funding if the region received an increase in grant funding due to PPACG reporting NTD data. 

Both parties have since learned that PPACG cannot obtain an NTD identification.  Instead, each of the individual specialized transportation providers must obtain their own identification numbers and report their own data.  

The revised IGA requires PPACG to assist those individual specialized transportation providers in reporting NTD data.  The City will provide PPACG $220,000 in 2023 in support of the Specialized Transportation Program. If NTD reporting requirements are not met, this amount may be reduced to $126,000 in 2024.  The proposed agreement term is January 1, 2023 through December 31, 2023, but may also be extended up to an additional 15 years upon mutual agreement of the parties.

  Previous Council Action:

On January 12, 2021, City Council approved a similar Intergovernmental Agreement (IGA) between the City and the Pikes Peak Area Council of Governments (PPACG) via Resolution 03-21.

 

  Financial Implications:

The Intergovernmental Agreement (IGA) will transfer $220,000 in Pikes Peak Rural Transportation Authority (PPRTA) Transit funds to the Pikes Peak Area Council of Governments (PPACG) in 2023 and between $126,000 and $220,000 in 2024 and thereafter if both parties agree to extend the agreement. 

 

  City Council Appointed Board/Commission/Committee Recommendation:

The Citizens Transportation Advisory Board (CTAB) recommended that City Council approve the Intergovernmental Agreement at its October 4, 2022 meeting.

 

  Stakeholder Process:

Transit Services Division staff and the staff from PPACG met and discussed modifications to the 2021 Intergovernmental Agreement (IGA) and worked to include language in the proposed IGA that meets each party’s goals and helps ensure that regional specialized transportation needs are met.

 

  Alternatives:

City Council may approve with conditions or deny the Resolution regarding the Intergovernmental Agreement.

  Proposed Motion:

Move to approve the Resolution between the City of Colorado Springs and the Pikes Peak Area Council of Governments effective January 1, 2023.
