  Summary:

The Pikes Peak Rural Transportation Authority (PPRTA) Board of Directors (Board) is proposing a Fifth Amended and Restated Intergovernmental Agreement among El Paso County, Colorado, the City of Colorado Springs, the City of Manitou Springs, the Town of Green Mountain Falls, the Town of Ramah, and the Town of Calhan regarding the PPRTA (Establishing IGA). The amendment will formally include the Town of Calhan in the Establishing IGA, authorize the addition of one Director to represent the Town of Calhan on the Board, and contemplate the November 8, 2022, ballot measure to extend the fifty-five percent of the one-cent sale tax for transportation capital improvements for a period of ten (10) years.

This action does not include the proposed November 2022 ballot language or the associated project lists. The weighted voting provision in Section 6.15 maintains the City’s one-third representation on the PPRTA Board.

 

  Background: 

In July 2021, City Council approved Resolution 97-21 in favor of the Town of Calhan joining PPRTA. The Town of Calhan electorate voted in favor of joining PPRTA in November 2021, and they became a member as of January 1, 2022.

The amended Establishing IGA formally incorporates the Town of Calhan into the establishing document. The amendment also includes a Director representing the Town of Calhan for the governing board. The weighted voting provision in Section 6.15 maintains the City’s one-third representation on the PPRTA Board of Directors. With six member governments, the Town of Calhan has 0.75 vote.

The amended Establishing IGA also acknowledges the PPRTA Board will issue a ballot question on November 8, 2022, to extend the fifty-five percent of the one-cent sales tax for transportation capital improvements for a period of ten (10) years. The current sunset on the fifty-five percent portion of the sales tax is December 31, 2024. The new sunset of this portion of the tax would be December 31, 2034. The proposed ballot language with the project lists will be presented to City Council for endorsement under a separate action.

Section 11 of Establishing IGA permits amendments to the Establishing IGA upon the unanimous consent of all member governments, and consent shall be manifested by a two-thirds affirmative vote of the membership of each governing body.
