Summary:
The Parks, Recreation and Cultural Services Department is proposing the sale of a 6,447 square foot parcel located across 26th Street from Fairview Cemetery. The Property, which is known as El Paso County Tax Schedule Number 74151-00-019, is depicted on Exhibit A, and is not being used by Parks or any of its enterprise operations. No other City department or enterprise has expressed interest in maintaining ownership of the Property, and therefore the Parks Department desires to dispose of the Property.
Background:
The Parks, Recreation and Cultural Services Department currently owns approximately 6,447 square feet of vacant land adjacent to South 26th Street and across from the Fairview Cemetery. It was purchased for back taxes in 1974 for approximately $50.00. The Property, which is known as El Paso County Tax Schedule Number 74151-00-019, is not being used by Parks or any of its enterprise operations and there are no future plans for this site. Additionally, no other City department or enterprise has expressed interest in maintaining ownership of the Property. Thus, the Parks Department desires to dispose of the Property.
Section 7.7.1804(A) of the City Code of the City of Colorado Springs, 2001, and Chapter 5 of the City of Colorado Springs Procedure Manual for the Acquisition and Disposition of Real Property Interests, Revised 2021 (“RES Manual”) authorizes the disposal of surplus property, upon City Council approval, following the advertising of said property for sale. The City advertised the Property for sale through its Sealed Bid Auction process and Ms. Paula J. LeBaron was the successful bidder, as defined in Chapter 5 of the RES Manual. The Parks Department recommends the disposal of the Property to Paula J. LeBaron as the successful bidder for the Property in accord with City Code and the RES Manual Pursuant to Article 11-80 (c)(5) of the City Charter.
Of note, the Property may be conveyed without requiring a vote of the people as it is not included in the Parkland Designation List.

Financial Implications:
The accepted bid for the parcel is $21,602 which will be received by the Cemetery Enterprise as revenue.
City Council Appointed Board/Commission/Committee Recommendation:
The Parks, Recreation and Cultural Services Advisory Board reviewed the proposed sale at its November 18, 2021 board meeting and voted unanimously to support the sale of the property with the funds being deposited into the Cemetery Enterprise’s revenue account.
