Summary:
The attached Resolution authorizes the City to acquire a 0.089 Acre Permanent Easement and a 0.038 Acre Temporary Construction Easement ("Easements") for the South Cascade Avenue Bridge Replacement Project ("Project"). The legal description and exhibits are attached to the proposed Resolution as Exhibits A and B, respectively.

Background:
The Project will replace a 95-year-old earth filled concrete arch that is functionally obsolete. The existing structure is narrow with no shoulders or sidewalks. The replacement bridge will be wider to better accommodate all modes of travel. In addition to the bridge replacement itself, some in-channel work is necessary to ensure that the channel grade remains stable. In general, streams and channels in this part of town are not publicly accessible property. The Project requires access to the channel to provide channel grade stabilization between the existing South Tejon Street Concrete Box Culvert and the proposed South Cascade Avenue Concrete Arch Bridge.

Pursuant to The City of Colorado Springs Procedure Manual for the Acquisition and Disposition of Real Property Interests ("RES Manual") Chapter 8, an appraisal for the Easements that supports the purchase price of $75,100 was obtained.

Pursuant to the provisions of the Colorado Constitution and the Colorado Springs City Charter, the City is empowered to acquire real property necessary for City's capital projects. Additionally, pursuant to Section 4.1 of the RES Manual and City Code 7.7.1802, City Council must approve property acquisitions if the total acquisition amount of the property interest acquired in the transaction exceeds $50,000.
