Ordinance No. 20-6 amending Ordinance No. 19-87 (2020 Appropriation Ordinance) for a supplemental appropriation to the General Fund in the amount of $329,828 for partial construction costs of the Tutt Boulevard Bridge over Cottonwood Creek.

  Summary:

The attached Ordinance is a supplemental appropriation to the revenue and expenditure budgets of the General Fund in the amount of $329,828. The Ordinance will recognize as revenue the bridge surcharge fees currently held in escrow, and will provide the revenue to the Public Works Department for construction of the Tutt Boulevard Bridge over Cottonwood Creek.

The source of funds for the General Fund is the bridge surcharge fees currently held in escrow.

NOTE: Subsequent to introduction at City Council Work Session on December 9, 2019, funds were received into the Tutt Bridge over Cottonwood Creek escrow account on December 18, 2019.  This increased the total funds available for this project to $329,828, therefore the amount of this supplemental appropriation has been adjusted to match available funds.

 

  Background: 

The construction of the Tutt Boulevard Bridge over Cottonwood Creek is needed in order to construct the Tutt/Cowpoke Detention Facility (PR-2/Project). The funds requested in this supplemental appropriation will partially offset the total project cost of $3,500,000.  The remaining cost of this project will be funded within the Stormwater capital projects.

Between 2003 and 2014, the Reel and Powerwood Annexation agreements (see Exhibit A) were approved by City Council with the stipulation that fees would be assessed and collected when property was platted to fund the construction of the Tutt Bridge over Cottonwood Creek. The location of this bridge has been identified where Tutt Boulevard will cross Cottonwood Creek and extend north from its current location at the intersection of Tutt Boulevard and Cowpoke Road as detailed in the City’s Major Thoroughfare Plan (see Exhibit B).

The proposed roadway embankment and box culvert that will be constructed with this project meet the definition criteria of a “bridge” as described in City Code § 7.7.1002 since the embankment and culvert (outlet structure from Pond) will carry the Arterial roadway (Tutt Boulevard ) over Cottonwood Creek (natural drainage way).

The City is committed to constructing PR-2 per the Intergovernmental Agreement (IGA) with Pueblo County at this location beginning in 2020. The functionality of this facility necessitates that a roadway embankment be constructed over Cottonwood Creek for the extension of Tutt Boulevard, with the roadway embankment serving as a “dam” for the detention facility. A culvert will also be constructed under the embankment such that water flowing in Cottonwood Creek can be conveyed under Tutt Boulevard at all times. The embankment and culvert will impound storm water runoff to reduce discharge rates during the 100 year storm event as required by the City’s Drainage Criteria Manual and the IGA with Pueblo County.

  Previous Council Action:

On December 5, 2019, City Council approved the original 2020 budget per Ordinance No. 19-87 (2020 Appropriation Ordinance). 

 

  Financial Implications:

The supplemental appropriation increases the 2019 General Fund revenue and expenditure budgets by $329,828. The funds will be recognized as revenue into the General Fund as a transfer from the escrow account. The funds will be expended by the Public Works Department in a General Fund project in the amount of $329,828. The source of funds is the Tutt Boulevard Bridge Fees, which are currently held in escrow. The net effect to the General Fund balance will be zero.  The funds transferred from escrow to the General Fund have no impact on the TABOR refund/retention calculation.

 

  City Council Appointed Board/Commission/Committee Recommendation:

The City Council Budget Committee has reviewed and recommended approval of this supplemental appropriation request at their meeting on November 21, 2019.
