  Summary:

Colorado Springs Utilities (“Utilities”) is proposing to provide Interim Outside City Wastewater Service to the Sterling Ranch Metropolitan District No. 1 (Sterling Ranch)

 

  Previous Council Action:

  Background:

Sterling Ranch is a metropolitan district located outside of the Colorado Springs City limits that serves the Sterling Ranch development. The development is located north of Woodmen Road between Colorado Springs and the Falcon area and is made up of approximately 1,900 acres. At full build out, the development will include approximately 5,800 single family equivalent units and 287 lots have currently been platted within the development.

Sterling Ranch is seeking interim wastewater treatment service from Utilities for the 287 platted lots while the owners of the development discuss annexation of the development and adjacent areas with the City. Utilities  has determined that wastewater for up to 700 lots in Sterling Ranch could be collected and treated in Utilities’ existing collection and treatment system with no adverse impact to Utilities’ existing infrastructure.

Utilities has negotiated the attached draft agreement with Sterling Ranch for the provision of interim wastewater treatment service to the 287 platted lots while annexation discussions are pursued. The agreement contains the following key terms:

1.  One-year special contract for wastewater treatment service with Sterling Ranch for 287 platted lots with renewal options;

2. Sterling Ranch will be required to cause owners of property within the Sterling Ranch Master Plan area to submit petition for annexation in a form acceptable to the City within 90 days of connecting to Utilities’ wastewater system;

3.  Sterling Ranch will pay outside City development charge for 3” connection and pay outside City special contract rates for wastewater;

4.  Compliance with applicable City/Utilities resolutions, codes, ordinances, regulations and policies related to annexation and utility service; and

5.  Construction of all public improvements in accordance with City standards and requirements for public improvements built after execution of special contract.

The draft agreement and a resolution approving the agreement are attached to this memo.
