Stormwater: Proposed Utilities Rules and Regulations Changes

Summary:
At the May 8th City Council Regular Meeting, the City Attorney’s Office - Utilities Division will present proposed changes to the Utilities Rules and Regulations (“URR”) intended to facilitate Utilities’ invoicing, billing, and collecting (collectively “billing”) of residential Stormwater service fees. Similar proposals to the City Code will be presented under an adjacent agenda item.

Background:
Following the agreement with the City of Colorado Springs (“City”) for Utilities to bill residential Stormwater services fees, Utilities believes that the proposed changes are necessary to facilitate the commencement of billing on July 1, 2018. The proposed changes have been vetted by both Utilities and the City.
The proposed changes mirror the Stormwater Ordinance, approved by the voters of Colorado Springs on November 7, 2017, and eliminate any ambiguity between the relevant provisions. The proposed changes do not conflict with or modify the Stormwater Ordinance and do not adversely impact Utilities’ customers.
City Council will be asked to approve the changes to the URR via resolution in accordance with City Code Section 12.1.107(D) because the proposed changes do not require a full rate hearing due to the lack of adverse impact to Utilities’ customers.
Financial Implications:
The proposed changes are necessary for Utilities to begin residential Stormwater service fee billing on July 1, 2018.
