Summary:
The attached Second Amended and Restated Intergovernmental Agreement ("IGA") governs the El Paso-Teller County Emergency Telephone Service Authority ("Authority") which the City has been a member of since the Authority's creation in 1989. The Restated and Amended IGA is necessary to properly reflect changes in the law and to make changes in the Authority's organization, administration, and operation.
Previous Council Action:
On November 16, 1999, City Council approved a resolution authorizing the First Amended and Restated Intergovernmental Agreement modifying the original Intergovernmental Agreement to reflect changes in Colorado law.
In July 1989, City Council approved a resolution authorizing the City's participation in the El Paso-Teller County Emergency Telephone Service Authority.
Background:
The governmental entities in El Paso and Teller counties entered into the 1989 Intergovernmental Agreement pursuant to the provisions of Article 11 of Title 29 and Part 2 of Article 1, of the Colorado Revised Statues. The 1989 Intergovernmental Agreement created a separate legal entity known as the El Paso-Teller County Emergency Telephone Service Authority and made it responsible for administrating the operation of an emergency telephone service program.
The Authority drafted the Second Amended and Restated IGA in order to:
1. Continue the existence of the Authority as a separate political subdivision and public corporation organized pursuant to Section 29-1-203.5, C.R.S.
