A Resolution Appointing Members to the Canyon Creek Metropolitan District No. 2 Board of Directors

Summary:
The Board of Directors for the Canyon Creek Metropolitan District No. 2 ("District') has been entirely vacated due to an exclusion of property from this district in 2017. Colorado Revised Statutes ? 32-1-905 (2.5) requires City Council action to appoint directors to an entirely vacated district board. The owners/District are requesting temporary appointments of three (3) of the previous directors until an election can be held in May of 2018.
Previous Council Action:
City Council approved a consolidated service plan for the Canyon Creek Metropolitan Districts ("Districts") on October 14, 2008 (Resolution 177-08).
In November 2015 Council approved an urban renewal plan for a larger area encompassing this District.
This agenda item was introduced at a Council work session on November 27, 2017.
Background:
The Districts provide financing and a source of reimbursement for qualifying public improvements for a portion of the South Nevada/South Tejon redevelopment areas. District No. 1 is the small developer-controlled operating district. District No. 2 is the residential district and District No. 3 is the commercial district. Since their creation in 2008 the Districts have been largely inactive until recently. They are intended to provide financing and operational functions within this area for this group of developers.
The Districts were created under the 2006 and still current Special District Policy, and with a Model Service Plan largely consistent with the City's currently adopted model. Districts No. 2 and 3 have a total levy of 40.0 mills in place but have no formally issued debt.
