Summary:
This Resolution will consolidate certain budgets to allow the Public Works Director and Stormwater Manager the flexibility they need to address MS4 permit requirements and reprioritize projects in order to deal with the concerns of the Department of Justice (DOJ), Environmental Protection Agency (EPA), Colorado Department of Health and Environment (CDPHE), and our downstream neighbors. Once this budget is transferred, the dollars can only be expended by Public Works, unless there is further action taken by City Council.
In accord with City Code § 1.5.107 and § 1.5.108, the Public Works Department is requesting that the budgets of certain Stormwater Capital Improvement Projects (CIP) projects be set to zero in the total amount of $3,150,000 and to transfer $3,150,000 of budget in the General Fund from the Finance Appropriating Department to the Public Works Appropriating Department for the Stormwater budget.
Previous Council Action:
On November 24, 2015, City Council approved the 2016 Budget per Ordinance No. 15-86.
Background:
The 2016 General Fund Budget originally appropriated $3,247,036 to the Public Works Appropriating Department for stormwater operations and $9,531,082 to the Finance Appropriating Department for the transfer to the City-Funded CIP Fund for Stormwater capital improvement projects. Since then, there have been new developments and ongoing discussions with the DOJ, EPA, CDPHE and Pueblo County Commissioners about stormwater issues. In order to reprioritize funding to address these issues, the Public Works Director is requesting that the budgets of certain Stormwater CIP projects be set to zero in the total amount of $3,150,000 and to transfer $3,150,000 of budget in the General Fund from the Finance Appropriating Department to the Public Works Appropriating Department for the Stormwater budget. This item supports the City’s strategic goal relating to investing in infrastructure by addressing Stormwater management and environmental concerns.
The budgets of certain Stormwater projects (project nos. 9370026, 9370029, 9370033, 9370034, and 9370039) will be set to zero and the budget of $3.15 million in the General Fund will be transferred from the Finance Appropriating Department to the Public Works Appropriating Department for the Stormwater budget.
Financial Implications:
With approval of this resolution, the budgets of certain Stormwater CIP projects in the City-Funded CIP Fund (202) in the total amount of $3.15 million will be set to zero, and $3.15 million of budget will be transferred in the General Fund from the Finance Appropriating Department to the Public Works Appropriating Department for the Stormwater budget. There is no change to the General Fund expenditure budget or appropriation authority.
