  Summary:

At the May 8th City Council Regular Meeting, the City Attorney’s Office - Utilities Division will present proposed changes to the City Code, Chapter Twelve, intended to facilitate Utilities’ invoicing, billing, and collecting (collectively “billing”) of residential Stormwater service fees.  Similar proposals to the Utilities Rules and Regulations will be presented under an adjacent agenda item.

  Background:

Following the agreement with the City of Colorado Springs (“City”) for Utilities to bill residential Stormwater services fees, Utilities believes that the proposed changes to the City Code are necessary to facilitate the commencement of billing on July 1, 2018.  The proposed changes have been vetted by both Utilities and the City.

The proposed changes mirror the Stormwater Ordinance, approved by the voters of Colorado Springs on November 7, 2017, and eliminate any ambiguity between the relevant provisions.  The proposed changes do not conflict with or modify the Stormwater Ordinance and do not adversely impact Utilities’ customers.

Please note that at the April 18, 2018, Utilities Board meeting it was explained that the City Code changes would be broken into two ordinances; however, in light of the changes made to the City Code in relation to governance updates, all Stormwater service fee changes are now located in Chapter 12 and only require a single ordinance.

 

  Financial Implications:

The proposed changes are necessary for Utilities to begin residential Stormwater service fee billing on July 1, 2018.
