Ordinance No. 18-23 amending Section 402 (Purpose and Specific Requirements of the Special Purpose Zone Districts) of Part 4 (Special Purpose Districts), Section 717 (Mixed Use Pedestrian and Bicycle Access and Circulation) of Part 7 (Mixed Use Zone Districts) and Section 903 (Definitions) of Part 9 (Traditional Neighborhood Development) All of Article 3 (Land Use Zoning Districts) of Chapter 7 (Planning, Development and Building) of the Code of the City of Colorado Springs 2001, as amended pertaining to Parks

  Summary:

This amendment proposes to update Chapter 7 of the City Code as part of the Parks Code Scrub project which spans multiple chapters of the City Code. All changes to Chapter 7 (FIGURE 1) of the City Code need to be reviewed by the Chapter 7 Code Scrub Committee and a recommendation to City Council made by the City Planning Commission.

The proposed draft will revise the following:
                     Update references to the Parks and Recreation Department to add Cultural Services to
           its name.
                     Change the reference in City Code § 7.3.402B PK- Public Park Zone Districts from
           “tennis” to “sport” courts to reflect other court uses such as pickle ball.
                     Adds “cultural” resources reference to City Code § 7.3.402B.
                     Strikes language pertaining to City Code § 7.5.1007 review to align with the inclusion of
           those standards as applicable in Chapter 4 of the City Code. The proposed Chapter
           4 revisions are included for comparison purposes. 

 

  Previous Council Action: 

The only official City Council action to date was a recommendation to assign City Councilmembers to each Department to assist with their respective code revisions.  City Council President Merv Bennett assigned City Councilmember Pro-Tem Jill Gaebler and City Councilmember Tom Strand to the Parks, Recreation and Cultural Services Department.

During City Council Park briefings all City Councilmembers have received the draft versions for review and comment.

 

  Background:

As part of a citywide effort to review and update the City of Colorado Springs City Code, the Parks, Recreation and Cultural Services Department engaged in a two year process to review the code provisions pertaining to parks, recreation and cultural services and to identify and recommend changes that were necessary to update the City Code. City Code provisions pertaining to this department span Chapters 1, 2, 4, 6, 7, 9 and 10. The proposed changes to Chapter 7 were reviewed by the Chapter 7 Code Scrub Committee on July 26, 2017. The Chapter 7 Code Scrub Committee voted unanimously to recommend approval of the code revisions.

This item supports the City’s strategic goal relating to excelling at City services by utilizing periodic evaluations and reviews to ensure accurate documentation of policies and procedures.

  Board/Commission Recommendation:

The Parks and Recreation Advisory Board voted unanimously to support the proposed Code revisions at its March 9, 2017 meeting.

The City Planning Commission voted unanimously to support the proposed Code revisions at its August 17, 2017 meeting.

  Stakeholder Process:

Standard land use notification is not utilized for legislative code changes, as the proposed application affects all City residents and property owners.  The City Code revisions for the Parks related provisions were developed through a parks code scrub committee consisting of members of the department’s management team and members of the Office of the City Attorney. After the first drafts were developed, the drafts were reviewed by executive department senior staff, Parks and Recreation Advisory Board members and two members of City Council assigned to the Parks code scrub effort.

After this review, the proposed code changes were noticed, presented and discussed in open session at the February 9, 2017 Parks and Recreation Advisory Committee meeting. Stakeholder comment prompted the update to change the Department’s name as referenced in the City Code from “Parks and Recreation Department” to “Parks, Recreation and Cultural Services Department” and to specifically include reference to cultural services in the City Code.

As with the work of the Chapter 7 Code Scrub Committee, this process has relied on staff to develop and propose the code changes with Parks and Recreation Advisory Board review and comment. Individual code scrub committee members, Parks and Recreation Advisory Board members, and other stakeholders are able to continue to represent their perspectives throughout the process.  Review at the Planning Commission level will provide another opportunity for comment on the proposed updates to Chapter 7.
