Summary:
Colorado Springs Utilities is proposing an ordinance that amends Chapter 12, Article 5 of the City Code, which is the City of Colorado Springs’ Wastewater Code. The purpose of the amendments is to revise Colorado Springs Utilities’ local limitations. The proposed ordinance will be presented to City Council for consideration and first reading on the consent calendar on January 24, 2017.
Previous Council Action:
The most recent revision to Chapter 12, Article 5 of the City Code was in 2014 when wastewater regulations within the Article were revised to be aligned with federal requirements, limits for BTEX, benzene, and pH were established, conditions of the Liquid Waste Hauler Program were modified, and general housekeeping items were addressed.
Background:
Colorado Springs Utilities is proposing an ordinance that would amend Chapter 12, Article 5 of the City Code, which is the City of Colorado Springs’ Wastewater Code. As a condition of the Colorado Discharge Permit System (CDPS) permits issued for Colorado Springs Utilities’ wastewater treatment facilities, the Industrial Pretreatment Program (IPT) is required to evaluate local limitations within 180 days of permit issuance. As a result of this evaluation, IPT determined that Article 5 needs to be amended so that new technically-based local limits may be implemented. The revised local limits are shown in the attached proposed ordinance. The revised local limits have been reviewed by the EPA and were determined to be approvable. Colorado Springs Utilities will bring the proposed ordinance amending Article 5 to include the revised local limits to City Council for consideration and first reading on the consent calendar at its January 24, 2017 meeting. After the first reading, the amendments will be publicly noticed by EPA for thirty days. If the EPA’s notice does not result in additional revisions to the local limitations, Colorado Springs Utilities plans on bringing the proposed ordinance to City Council for second reading in March.
