  Summary:

The University of Colorado Colorado Springs (UCCS) is requesting City vacation of a portion of the right-of-way of Cragmor Village Road (Figure 1). The property adjacent to the proposed vacated right-of-way is entirely owned by UCCS (Figure 2). The street is not constructed within this portion of the right-of-way.

 

  Previous Council Action: 

None

 

  Background:

Cragmor Village Road is a short, dead-end street that is not built to City standards. The street is located north of Austin Bluffs Parkway and east of the main UCCS campus. Cragmor Village Road begins at its intersection with Regent Circle (located within the UCCS campus) and extends east approximately one-third (1/3) of a mile. The easterly half of the street is the portion requested for vacation and is entirely surrounded by property owned by UCCS. No street improvements exist within the right-of-way requested for vacation. The majority of the right-of-way for this portion of Cragmor Village Road was dedicated to the City in 2003 with the University Summit subdivision. This 19-lot, single-family subdivision was never developed. UCCS has since acquired all of the lots.

The right-of-way proposed for vacation is not necessary for City transportation purposes and will not adversely affect access to surrounding lots. Public utilities which are located within the right-of-way will be accommodated by a separate public utility easement which has been submitted to the City. A vehicular turnaround at the proposed termination of the street is provided on UCCS property. UCCS has provided a public improvement easement to accommodate this movement. No City agencies objected to the vacation request.

The UCCS Master Plan indicates the entire Cragmor Village Road neighborhood is intended to be used for University purposes. The vacation of this unneeded right-of-way will assist the University with this goal. The right-of-way to be vacated does not extend along the street frontage for the recently approved Lookout on Cragmor student housing project. This project fronts onto Cragmor Village Road further to the west and will not be impacted by the proposed vacation.

  Board/Commission Recommendation:

As required by Section 7.7.402.B.2 of the City Code, a request to vacate right-of-way is placed directly onto a City Council agenda for action after review by the administration. No review by a board or commission is required.

 

  Stakeholder Process:

Public notice was provided to eight (8) property owners, none of which front onto the right-of-way requested for vacation. No correspondence was received.

 

  Alternatives:

1.                     Approve the application as recommended by staff;
2.
                     Deny the application; or
3.
                     Refer the application back to staff for further consideration.

 

Recommended Action

Approve the vacation of the right-of-way for Cragmor Village Road, based on the finding the request complies with the review criteria in City Code Section 7.7.402.C (Review Criteria for the Vacation of Right-of-Way).
