Summary:
A new ordinance is necessary to amend City Code ? 8.7.204 to codify that the approval of the Emergency Operations Plan (EOP) will be the responsibility of the Mayor as an executive function.

Previous Council Action:
N/A

Background:
The Colorado Springs City Charter states that the municipal government is a Council-Mayor Government, where all executive and administrative duties and powers are vested in the Mayor, and the legislative powers are held by the City Council. Currently the Colorado Springs City Code requires the City Council to approve the Emergency Operations Plan (EOP) which is developed by the Office of Emergency Management (OEM) . Upon legal review it was determined that approval of the EOP would qualify as an executive or administrative function, rather than a legislative function and therefore it is recommended that a new ordinance be adopted designating that the Mayor approves the EOP.
