Summary:
Colorado Springs Utilities (Utilities) requests approval of amendments to Part 6, Article 5, Chapter 1 of the City Code pertaining to workers' compensation claims management and administration of workers' compensation reserve funds.
The City currently administers a workers' compensation reserve fund on Utilities' behalf. The proposed amendments would create two separate workers' compensation reserve funds that would be independently administered by the City and Utilities. The ordinance also: (i) clarifies requirements related to reserve funding, claims administration, audits, and litigation, and (ii) aligns the Code with best practices for governance and workers' compensation claims management.
Background:
Part 6, Article 5, Chapter 1 of the City Code governs the administration of workers' compensation claims and reserve funds for the City and Utilities. During a review of workers' compensation and self-insurance administration practices, staff identified provisions that appear to be a legacy from the period when Utilities operated as a City department and did not have its own Chief Financial Officer (CFO).
