Summary:
This ordinance authorizes the City Attorney to appoint Hearing Officers for any reason required or permitted by law. This includes resolving disputes arising from the Transit Safety Committee, which is required by and created in compliance with federal law.
Background:
The City Attorney currently has authority to appoint hearing officers in limited circumstances which includes, "hearing officers to resolve disputes as otherwise authorized in this Code or in the tariffs of the Utilities." City Code ? 1.2.409. The current City Code provision does not cover the newly established Transit Safety Committee. The City of Colorado Springs, doing business as Mountain Metropolitan Transit (MMT), is the direct recipient of Federal Transit Administration funding and is subject to federal regulations. Federal regulations require the agency to establish a Transit Safety Committee (Committee) composed of equal representatives of frontline employees and management staff that are responsible for conducting specific activities to oversee MMT's safety performance. This Committee is formally recognized by an administrative regulation signed by the Mayor. Per federal regulations, the Committee's bylaws must contain a dispute resolution procedure to ensure the committee can carry out its responsibilities.
