Title
A Resolution Approving a Trackage and Development Agreement for a Rail Served Industrial Park Project.

Presenter:
Bethany Burgess, Utilities Division Chief, Office of the City Attorney
Travas Deal, Acting Chief Executive Officer, Colorado Springs Utilities

Body
Summary:
Colorado Springs Utilities (Springs Utilities) staff, the City Attorney's Office, and representatives of a proposed Rail Served Industrial Park Project will present information regarding a Trackage and Development Agreement and the project itself, and seek approval of a Resolution approving the Agreement.

Background:
In 2017, Springs Utilities began discussions with the City of Colorado Springs, the City of Fountain, El Paso County, the Colorado Springs Chamber of Commerce and Economic Development Corporation, and representatives of a proposed rail served industrial park being proposed for construction to the West of Springs Utilities' Clear Springs Ranch regarding the possible shared use and expansion of Utilities' existing rail spur. With support from the Board at that time, Springs Utilities provided a Letter of Conditional Support for the project articulating Springs Utilities' overall support for the project so long as there were no adverse impacts to Springs Utilities' operations or Spring Utilities' ratepayers.

The proposed trackage agreement establishes the framework for the shared use and expansion of the existing rail, grants necessary easements, and establishes responsibilities for costs, all as presented to the Utilities Board in its January meeting.
