Summary:
The City Public Works Department requests a resolution authorizing the disposal of 16,019 square feet of surplus property located between 610 and 630 Abbot Lane, Colorado Springs, Colorado (the "Property") to the Humane Society of the Pikes Peak Region ("HSPPR") as the one logical, potential purchaser.

Background:
HSPPR owns the parcels on either side of the Property and has expressed a desire to purchase the Property from the City so that they have one contiguous parcel. The Property, currently controlled by the City's Public Works Department, is used to convey drainage from the west and may be deemed surplus and be sold to the Humane Society provided a drainage easement is retained the City. HSPPR has agreed to pay the City the appraised value of $2,100.00 for the Property.
The Public Works Department desires to dispose of the Property and will reserve a drainage easement over the entire Property for stormwater purposes.
In accord with Section 5.4 of the City of Colorado Springs Procedure Manual for the Acquisition and Disposition of Real Property Interests (the "Manual"), based on the configuration of the Property and its adjacent location to the HSPPR property, Public Works believes that HSPPR is the one logical, potential purchaser. Section 5.4 of the Manual states:
5.4 One Logical, Potential Purchaser. If there is only one logical, potential purchaser of the property, the Controlling Department may seek City Council authorization to sell the property to the identified purchaser subject to appropriate terms and conditions and the provisions of this Manual.
