Procedural Changes Pursuant to Unified Development Code (UDC)

Summary:
Pursuant to the UDC, certain quasi-judicial land use hearings, including rezoning hearings, must take place after first reading and prior to second reading of the ordinance.
In order to highlight and clarify the procedure, City Staff has recommended updating the titles of rezoning ordinances on first reading to clarify that the purpose of first reading is to set a hearing date and publish the proposed ordinance. The motion has also been updated to state the purpose of first reading is to set a hearing date and publish the proposed ordinance.
The process for conducting quasi-judicial hearings is still governed by the Rules and Procedures of City Council, which includes an opportunity for public comment.
Background:
This procedural change was recommended to Council at the August 22, 2022 City Council meeting and appeared in all subsequent drafts of the UDC.
Previous Council Action:
City Council adopted the UDC with an effective date of June 5, 2023.
City Code ? 7.5.407(D)(3)(c): In all matters before the City Council where an ordinance is required to give effect to a quasi-judicial land use decision or where an ordinance is accompanied by a related quasi-judicial application pursuant to Subsection 7.5.403D (Multiple Applications), Council shall vote on the ordinance on first reading without conducting a hearing or taking public comment. Hearings for the ordinance and any related applications shall be conducted prior to the second reading of the ordinance.
