Title
Ordinance No. 14-71 amending Section 207 (Perishable or Hazardous Property) of Part 2 (Custody of Property and Weapons) of Article 1 (Administration and Enforcement) of Chapter 9 (Public Offenses) of the Code of the City of Colorado Springs 2001, as amended, pertaining to destruction of perishable and hazardous property

Body
 From:
Chief Peter Carey, Colorado Springs Police Department

 Summary:
The Colorado Springs Police Department (CSPD) seeks the approval of the proposed ordinance to avoid employee exposure and health risks associated with the decay, spoilage, or deterioration of perishable items.

 Previous Council Action:
N/A

 Background:
As the perishable item intake has increased over the years, CSPD employees are increasingly exposed to mold, foul odors, maggots, spillage, and other effects of decaying perishable items.  CSPD no longer has the general storage space or refrigerator/freezer capacity to store perishable found property or seized property items other than those items held as evidence.  The proposed ordinance modifies City Code ยง 9.1.207 to allow property seized or taken possession of by CSPD that is perishable and impracticable for sale to be disposed of immediately.

  Financial Implications:
Without this proposed amendment to the City Code, CSPD may have to lease additional storage space and purchase additional refrigerators and freezers to accommodate found property perishable items.

 Board/Commission Recommendation:
N/A

 Stakeholder Process:
CSPD worked with the City Attorney's Office to draft the proposed ordinance.
  Alternatives:
The City Code section will not be changed.

Recommended Action
 Proposed Motion:
Motion to approve the ordinance as presented.

Ordinance Language
An ordinance amending City Code to authorize the Colorado Springs Police Department to immediately dispose of perishable property seized or taken possession of by the department.
