City Stormwater Enterprise staff requests City Council approval of a resolution accepting a donation of real property from Armstrong Financial Services, LLC (the "Armstrong Parcel") to the City of Colorado Springs for the Flood Control - Colorado Springs Sand Creek/Karr to West Fork Stabilization Project.

Background:
Due to the historic slope instability within the Sand Creek Channel, the City negotiated with Pueblo County to add multiple segments within Sand Creek to the IGA project list. The "Flood Control - Colorado Springs Sand Creek/Karr to West Fork Stabilization Project" was one of the segments added to the IGA. The City is required to design and construct the stabilization improvements within the channel to meet the requirements set forth in the IGA. It is necessary for the City to own the Armstrong Parcel in order to complete the Project. The Project is scheduled to begin in 2024 and has a budget of $3,507,000.

City staff has negotiated the acquisition of the 5.3679 acres of property owned by Armstrong Financial Services, LLC ("Armstrong"). As a result of these negotiations, Armstrong has agreed to donate the Armstrong Parcel to the City of Colorado Springs.

Pursuant to the provisions of the Colorado Constitution and the Colorado Springs City Charter, the City is empowered to acquire real property necessary for City capital projects.
