Summary:
The Peak Metropolitan District Nos. 1, 2 and 3 (the "Districts") was created under the City's pre-2022 model service plan which has a maximum operations and maintenance mill levy of 10 mills.
This is a request to allow additional permitted operations and maintenance services listed in Exhibit D of the metropolitan district service plan. Currently, the description of services includes street and landscape maintenance, programming and management of park and recreation, security, operation, maintenance, and administration services. The proposed amendment consists of the addition of stormwater improvements to the services listed in Exhibit D of the service plan. There are no changes to maximum debt or operations, and maintenance mill levy with this amendment.
As such, this request is being reviewed as a limited amendment to the service plan.
Background:
The Districts support a variety of non-residential uses associated with the Airport Business Park. The Districts were organized pursuant to a Consolidated Service Plan approved by City Council on August 28, 2018, per Resolution No. 95-18.
A First Amendment to the Consolidated Service Plan for Peak Metropolitan District Nos. 1, 2, and 3 was approved by City Council on February 12, 2019, by Resolution No. 22-19 (the "First Amendment"). The First Amendment authorized the Districts to provide covenant enforcement and design review services within the boundaries and service areas of the Districts. The First Amendment also modified Exhibit D to the Original Service Plan to specifically authorize the Districts to undertake and provide certain operations and maintenance services.
