  Summary:

The proposed resolution would authorize the purchase of real property interests from JE Martin, LLC and Jennifer Rasmussen (collectively, the “Property Owner”) needed in connection with the Tutt Boulevard Extension: Dublin Boulevard to Templeton Gap Road Project. The Project and property purchase would be funded by the Pikes Peak Rural Transportation Authority (“PPRTA”).

 

  Background: 

The City of Colorado Springs (“City”) completed the Tutt Boulevard Extension: Dublin Boulevard to Templeton Gap Road Project (the “Project”). The Project was identified by the PPRTA as an “A-list” priority project, and total project funding is $5,279,518. The extension of Tutt Boulevard from Dublin Boulevard to Vickie Lane was completed in 2016. Construction on the extension of Tutt Boulevard from Vickie Lane to Templeton Gap Road began on March 27, 2024, and was completed September 17, 2024. (See Project Location Map).

JE Martin LLC and Jennifer Rasmussen (the “Property Owners”) jointly own property that is needed for the Project. The City needs approximately 0.857-acres (37,325 sf) for right of way in fee simple, approximately 0.130-acres (5,670 sf) as permanent easements, and approximately 0.152-acres (6,632 sf) of temporary construction easements (the “Property”) from the Property Owners for the Project.

The City provided the Property Owner with a Notice of Intent to Acquire the Property on November 29, 2022. Pursuant to Chapter 9 of The City of Colorado Springs Procedure Manual for the Acquisition and Disposition of Real Property Interests, Revised 2021 (“RES Manual”), the City secured an independent appraisal and presented the Property Owner with an offer to acquire the Property in the amount of $580,000 on May 26, 2023.

The Owner did not obtain an appraisal at the time the City provided its offer. On July 10, 2023, the City presented a settlement offer of $638,000. The settlement offer was rejected by the Property Owner.

On September 12, 2023, Resolution 127-23 was passed by City Council to authorize a Possession & Use Agreement or eminent domain to secure possession of the Property.

On October 10, 2023, the City provided a settlement offer of $754,000 to acquire the Property. The settlement offer was rejected by the Property Owner.

The Property Owner agreed to a Possession and Use Agreement on March 8, 2024. The City disbursed the City’s appraised amount of $580,000 to the Property Owner per the Possession and Use Agreement on April 18, 2024, and took possession of the Property to construct the Project.

On June 17, 2024, the Property Owner provided an independent appraisal of the value of the Property. The Property Owners’ appraisal concluded with a value of $1,218,250. The City and the Property Owner reached a negotiated settlement of $910,000 in March 2025.

The PPRTA Board approved the initial funding ($580,000) for the property acquisition during its December 13, 2023, meeting and is anticipated to approve the total purchase price ($910,000) on May 14, 2025, contingent on City Council approval.

Staff requests that City Council approve the Resolution for acquisition of the Property. Additionally, the attached Resolution authorizes the City’s Real Estate Services Manager and the Public Works Director to execute all documents necessary to complete the acquisition.

  Previous Council Action:

On August 14, 2012, City Council endorsed the extension of the Pikes Peak Rural Transportation Authority Capital Program in Resolution No. 109-12. Subsequently, on November 6, 2012, the citizens approved Ballot Issue 5A extending the PPRTA Capital Program until December 31, 2024, and the issue included this Project. On September 12, 2023, Resolution 127-23 was passed by City Council to authorize Possession & Use Agreement or Eminent Domain.

 

  Financial Implications:

This property acquisition cost is accounted for in the PPRTA project budget.
