Summary:
To formally integrate and execute the City’s Pikes Peak Rural Transportation Authority (PPRTA) capital projects included in the November 8, 2022, ballot, the City must execute the Third Amended and Restated Intergovernmental Agreement (Comprehensive IGA) between PPRTA and the City for Capital Projects, Maintenance Programs, and City-sponsored transit activities.
Background:
The purpose of this IGA is to formalize an agreement between the PPRTA and the City for the use of PPRTA funds on capital projects, maintenance programs, and City-sponsored transit activities. This agreement upholds the requirements of the original, establishing Intergovernmental Agreement, adopted following the PPRTA's creation by voters in 2004, as well as the five amendments that have been executed to date. As voters approved a second ten-year extension of the PPRTA in November 2022, which was set to expire on December 31, 2024, this proposed IGA will govern the extension period from January 1, 2025, to December 31, 2034.
At the July 10, 2024, PPRTA Board meeting, the PPRTA Attorney was directed to update the Comprehensive IGA between PPRTA and the City to include the capital projects authorized by a November 2022 ballot initiative which extended funding and included new projects. The PPRTA Attorney was also directed to update minor clerical issues. The PPRTA Board approved the Third Amended and Restated IGA at their September 11, 2024, meeting. The Comprehensive IGA generally covers the following topics:
1. Budget submittal process
2. Claims handling process
3. Stipulates each member government follows its own procurement processes
4. Warranties must name PPRTA as a beneficiary
5. Stipulates PPRTA will not own property or facilities
6. Submittal of quarterly reports
7. PPRTA will honor member government record requests
8. PPRTA will not pay for member government personnel
9. Lists the specific capital projects eligible for funding
The proposed redlines to the IGA were minor and are provided for reference to highlight the changes. Most items remain unchanged from the previous IGA. There were some changes necessary to reflect City process changes with the strong-mayor form of government. The Resolution would approve execution of the updated version of the Comprehensive IGA. The Comprehensive IGA has been reviewed by the City Attorney’s Office and the Public Works Department and all find the proposed amendment acceptable.
Previous Council Action:
On August 23, 2022, City Council endorsed the extension of the Pikes Peak Rural Transportation Authority Capital Program in Resolution No. 121-22. Subsequently, on November 8, 2022, the citizens approved Ballot Issue 7A extending the PPRTA Capital Program until December 31, 2034.
