  Summary:

This is a proposal for a land exchange to allow for the acquisition of ten (10) parcels and five (5) easements from James B. Klein (aka James Klein aka Bruce Klein), Date Street, LLC and The Shoppee LLC (collectively “Klein”) and the conveyance of three (3) parcels owned by the City of Colorado Springs (“City”) to Klein in connection with the Park Vista Drainage Improvement Project (“Project”).

 

  Background: 

The City of Colorado Springs (“City”) is currently soliciting bidders to construct the Project, and construction is anticipated to start in January 2025 with expected completion in July 2026.

The proposed property exchange will allow for the construction of channel improvements to the Templeton Gap Floodway (see location map for Project location).

Klein owns ten (10) properties within the Park Vista area required for the Project, totaling approximately 68,500 square feet of land identified by El Paso County Tax Schedule Numbers 6326211026, 6326211023, 6326211028, 6326211030, 6326211031, 6326211033, 6326211014, 6326211034, 6326211012, 6326211005 (“Klein Properties”). Collectively the Klein Properties are valued at $207,300.00

The Project also requires five (5) permanent easements, totaling 21,350 square feet on properties owned by Klein identified by El Paso County Tax Schedule Numbers 6326208003, 6326208001, 6326208004, 6326208005, 6326207001 (“Klein Easements”). Collectively the Klein Easements are valued at $79,000.00.

The City of Colorado Springs (“City”) owns three (3) properties within the Park Vista area, consisting of approximately 21,000 square feet of land controlled by the Public Works Department (“Public Works”) and identified by El Paso County Tax Schedule Numbers 6326208002, 6326206016 and 6236206017 (“City Properties”). Collectively, the City Properties are valued at $87,950.00. The Stormwater Enterprise (SWENT) will retain a 4,088 square foot easement for the Project over the parcel identified by El Paso County Tax Schedule Number 6326208002.

The resolution would authorize the exchange of the Klein Properties and Klein Easements for the City Properties, plus a negotiated payment of $107,500.00 to Klein to cover the difference in value between the City Properties and the Klein Properties, the Klein Easements, and the costs of Klein’s appraisals.

  Previous Council Action:

On February 14, 2023, by Resolution No. 18-23, City Council approved the Intergovernmental Agreement between the City of Colorado Springs, Colorado and El Paso County, Colorado, regarding improvements to and future annexation of the Park Vista South area.

 

  Financial Implications:

The Project is partially funded by the City of Colorado Springs’ SWENT and El Paso County through American Rescue Plan Act (ARPA), and the expense is accounted for in the budget for this project.

The Property Owners have been engaged by the City since early 2024.
