Summary:
Pursuant to Colorado Revised Statutes section 31-16-203, the governing body of any municipality must schedule a public hearing upon introduction of an ordinance adopting a code by reference.
This item sets the public hearing date for November 13, 2018 and allows the City Clerk to publish notice of the hearing in compliance with C.R.S. section 31-16-203.
Previous Council Action:
On second reading on February 27, 2018, the City Council adopted the Pikes Peak Regional Building Code, 2017 Edition, 1st Printing, by reference.
Background:
Per statute, upon introduction of an ordinance proposing the adoption of a code by reference, City Council shall set a hearing date and cause notice of the hearing date to be published twice, once at least 15 days prior to the hearing and a second time at least eight (8) days prior to the hearing. As a result, at the October 23, 2018 Council meeting, the adopting ordinance will be “introduced”. City Council will then be asked to set a public hearing date of November 13, 2018 and to take no action on the ordinance at that time. The City Clerk will publish notice in accord with Council’s direction, and first reading on the ordinance adopting the Pikes Peak Regional Building Code, 2017 edition, will be at the public hearing during the November 13, 2018 formal City Council meeting.
The recommended amendments to the Pikes Peak Regional Building Code, 2017 Edition, will simplify the construction process, take advantage of new regulations, standards, code developments, studies, Flood Insurance Rate Maps (FIRM), or Flood Insurance Study (FIS) reports, adopted therein by reference, comply with requirements of the State of Colorado including the adoption of plumbing, electrical, and elevator/escalator safety codes that have been adopted as rules and regulations of Colorado state agencies, and comply with requirements of the Federal Emergency Management Agency (FEMA) including the adoption of amendments to the existing floodplain management regulations.
