  Summary:

Pursuant to Colorado Revised Statutes section 31-16-207, if at any time a code which a municipality has previously adopted by reference is amended by the agency which originally promulgated, adopted, or enacted it, the governing body may adopt such amendment by reference through the same procedure as required for the adoption of the original code, or an ordinance may be enacted in the regular manner setting forth the entire text of such amendment. Further, pursuant to Colorado Revised Statutes section 31-16-203, the governing body of any municipality must schedule a public hearing upon introduction of an ordinance adopting a code by reference. Notice of the hearing must be published twice in a newspaper of general circulation in the adopting municipality, once at least fifteen (15) days preceding the hearing, and once at least eight (8) days preceding it.

The recommended adoption of the Pikes Peak Regional Building Code, 2023 Edition, with amendments, will promote sustainable construction and continue to provide for the life safety and welfare of the built environment in a logical manner within the Pikes Peak Region. The amendments will simplify the construction process, take advantage of new code developments, increase energy efficiency, as well as comply with State of Colorado legislative requirements, including, but not limited to the continued timely adoption of mandatory plumbing, electrical, elevator/escalator safety codes, and other model codes that have been adopted or will be adopted as rules and regulations of the State of Colorado state agencies, and comply with requirements of the Federal Emergency Management Agency (FEMA). 

 

  Background: 

​​Per statute, upon introduction of an ordinance proposing the adoption of an amendment to a code, as originally adopted, by reference, City Council shall set a hearing date at its February 14, 2023 meeting and cause notice of the hearing date to be published twice, once at least fifteen (15) days prior to the hearing, and once at least eight (8) days prior to the hearing.   City Council will then be asked to set a public hearing date of March 14, 2023, and to take no action on the ordinance at that time.  The City Clerk will publish notice in accord with City Council’s direction, and a first reading of the ordinance adopting the Pikes Peak Regional Building Code, 2023 Edition, will be at the public hearing during the March 14, 2023 formal City Council meeting. A second reading of the ordinance adopting the Pikes Peak Regional Building Code, 2023 Edition, will be set for March 28, 2023.

  Previous Council Action:

​​On second reading on February 27, 2018, the City Council adopted the Pikes Peak Regional Building Code, 2017 Edition, 1st Printing, by reference. Thereafter, on second reading on November 27, 2018, the City Council adopted the Pikes Peak Regional Building Code, 2017 Edition, 2nd Printing, by reference.​
