Summary:
Repeal and replace Article 3 of Chapter 2 - Article 3 (Sales of Goods and Services) comprises most of the license types issued by the City Clerk’s Office. This ordinance reordains Article 3 which includes changes for structural hierarchy and flow outline to be consistent for all of specific license types and proposes renumbering parts to eliminate unused sections (from prior 2014 repeals). Other proposed changes to Article 3 include adding background check requirements for massage business employees as required by recent state legislation, updated insurance requirements for applicable license types, addressing emerging technologies, and conformance to applicable state statues. The final version of this ordinance includes minor language clarifications in Part 2 (Private Security Services) in consideration of stakeholder comments regarding camera-assisted technology and surrender of licenses, as follows:
§2.3.202: Definitions on page 11 - changes second sentence of Camera-Assisted Technology definition from “Camera-assisted technology includes, but is not limited to…” to now read “Camera-assisted technology categories include, but are not limited to…” (added “categories”).
§2.3.206(E) on page 13 - changed from “A list of any camera-assisted technology the agency will use” to now read “A list of the categories of camera-assisted technology the agency will use” (added “categories”).
§2.3.215(D) on page 27 - changed from “It is unlawful for any licensee or principal or managing agent of a contract security agency to fail to surrender a license or identification card to the City Clerk’s Office when required” to now read “It is unlawful for any licensee to fail to surrender a license or identification card to the City Clerk’s Office when required” (removed “or principal or managing agent of a contract security agency”).
Background:
The proposed changes to Business Licensing codes are the result of a multi-year effort to update and modernize the business licensing code for the City Clerk’s Office and are the initial entries for forthcoming comprehensive City Code updates.

Various individual parts within Article 3 of Chapter 2 have been updated over the years, primarily in 2014.

Stakeholder Process:
The City Clerk’s Office worked closely with the City Attorney’s Office, CSPD, CSFD, Planning, Finance, Human Resources Risk office and other departments on these updates. Draft proposed changes were distributed to current licensees for comment in late July, and again in mid-August.
