Title

Ordinance No. 16-32 renaming Article 2 (Amusements) and moving under the renamed Article 2 (Marijuana) Part 1 (Medical Marijuana License Code) and all subsequent sections (101-109) of Article 3 (Sales of Goods and Services) of Chapter 2 (Business Licensing, Liquor Regulation and Taxation) of the code of the City of Colorado Springs 2001, as amended, pertaining to marijuana

  Presenter:

Sarah B. Johnson, City Clerk

Body

  Summary:

Renaming unused Article 2 to Marijuana, and moving Medical Marijuana (MMJ) business license code to the renamed Article 2.

  Previous Council Action:

City Council approved Medical Marijuana Business Licensing with Ordinances 10-45 and 11-32.  City Council approved Ordinance 14-82 repealing business licenses under the title of Amusements.

On March 8, 2016, City Council approved this ordinance on first reading.

  Background:

With the possibility of licensing additional marijuana-type businesses in the City, a new category for Marijuana business licensing is needed.  The licensing code under Article 2 titled Amusements was repealed by Ordinance 14-82, reserving the Article for future use.  Article 2, then, can be used and renamed for general marijuana use. Existing Medical Marijuana Business License Code would then be moved under this renamed Article 2.  This ordinance makes no changes to the MMJ licensing code other that the identifying code numbers to reflect the new placement in Article 2, and makes it easier for a citizen to find relevant or related code sections if they are grouped together.  Potential changes to the existing Medical Marijuana business licensing code will then be addressed as a part of the City Council’s existing Medical Marijuana Task Force.
