  Summary:

This is a request to approve a resolution setting a public hearing date of December 8, 2015, and direct the City Clerk to advertise the hearing for the Mountain Valley Preserve Annexation.  The annexation area is 44.716 acres and located east of Marksheffel Road and south of Dublin Boulevard.

 

  Previous Council Action: 

Not Applicable

 

  Background:

Colorado State Statute provisions require that the City Council adopt a resolution that sets the hearing date and directs the City Clerk to advertise the pending annexation for four weeks prior to the public hearing. In addition, the hearing date must be no less than thirty (30) days or more than sixty (60) days after the effective date of the resolution setting the hearing.  The annexation can be advertised on the following dates: November 7, 2015, November 14, 2015, November 21, 2015 and November 28, 2015 to adhere to the statute requirements for the December 8, 2015 City Council meeting.  Approving the resolution and setting a public hearing for the proposed annexation does not obligate the City Council to approve the annexation in the future.

 

  Financial Implications:

Not applicable at this time.  A fiscal impact analysis has been prepared and will be provided to the City Council with the annexation hearing information packet.

 

  Board/Commission Recommendation:

The City Planning Commission considered and recommended approval of the annexation and associated zoning and concept plan applications on September 17, 2015. The CPC Record-of-Decision of the meeting provides the discussion of the application and will be provided with the annexation hearing information packet.

 

  Stakeholder Process:

The standard City notification process for the internal review and CPC hearing was used, which included posting the property with a notice poster and mailing postcards to 189 property owners within 500 feet of the project area.

 

  Alternatives:

City Council can approve or deny the resolution setting the date and authorizing advertisement of the public hearing for the annexation.  If the resolution is not approved and the hearing is not scheduled, the annexation cannot be considered.

 

Recommended Action

  Proposed Motion:

Move to approve the resolution setting December 8, 2015 as the hearing date for consideration of the Mountain Valley Preserve Annexation.
