Ordinance No. 24-09 Adding New Language to Article 10 of Chapter 12 (Utilities) of the Code of Colorado Springs 2001, as Amended, Pertaining to the Colorado Springs Underground Damage Prevention Safety Program (CSUDPSP or the Program).

  Summary:

This Ordinance is one of two Ordinances being proposed to improve Colorado Springs Utilities’ existing Underground Damage Prevention Safety Program, which has been operating successfully since 2020.

 

  Background: 

We are requesting three updates to the program to further the Programs’ ability to prevent underground damages. Changes include:

1) Modifying the language of City Code section 12.10.103 to provide CSUDPSP’s Program Manager the authority to enforce the rules and regulations promulgated by the Chief Executive Officer for excavation practices.

2.) Modifying the language of City Code section 12.10.103 to provide CSUDPSP’s Program Manage the authority to review and investigate alleged violations of this Article, serve as the utility enforcement officer and order remedial action or penalties, and adopt the necessary forms to operate the Program.

3) Modifying the language of City Code section 12.10.105 to state that it is a violation of this Article to fail to comply with any rule regarding CSUDPSP promulgated by the Chief Executive Officer.

  Previous Council Action:

The Colorado Springs Underground Damage Prevention Safety Program was created by City Ordinance (City Code, Chapter 12 Section 10) in 2020 enabling Colorado Springs to bring the enforcement of Colorado’s excavation and one call law to the local level for closer oversight.

The Utilities Board considered this ordinance at the January 17, 2024 Utilities Board meeting, and recommended this ordinance be placed on the Consent Agenda for a first reading at the City Council Regular meeting scheduled for February 13, 2024.
