  Summary:

The Stormwater Enterprise has developed an IGA (Intergovernmental Agreement) to enter into agreements with Non-Standard MS4 Permit holders within the City’s MS4 permit boundary.

 

  Background: 

The Colorado Department of Public Health and Environment (CDPHE) encourages Non-Standard MS4 permit holders such as school districts to obtain permit compliance by partnering with their local Phase 1 MS4 Permit holder.  Due to the small size of most Non-Standard Permittees, it is difficult to provide a self-sufficient program to meet all requirements of the State Non-Standard MS4 Permit.  Entering into agreements with local larger Phase 1 MS4 Permittees is beneficial for both parties.

The IGA between the City’s Stormwater Enterprise and a Non-Standard Permittee will detail the responsibilities for different MS4 Permit requirements, including construction, post-construction, illicit discharge, and public education programs.

  Financial Implications:

A fee will be applied for each IGA which will be billed to the Non-Standard Permittee.  The fee will be paid directly to the Stormwater Enterprise to offset operating costs related to participation in the IGA.  There is no impact to the General Fund.
