  Summary:

The Pikes Peak Rural Transportation Authority (PPRTA) Board of Directors (Board) is proposing a Sixth Amended and Restated Intergovernmental Agreement among El Paso County, Colorado, the City of Colorado Springs, the City of Manitou Springs, the Town of Green Mountain Falls, the Town of Ramah, and the Town of Calhan regarding the PPRTA (Establishing IGA). The amendment will require a super majority affirmative vote for projects proposed under the newly established “State and Federal Discretionary Grant Match Fund” program.

 

  Background: 

Prior to the November 2022 ballot measure for the PPRTA capital project renewal (PPRTA 3), the member governments staff, the Citizens Advisory Committee (CAC) and the Board prepared an extensive list of issues, referred to as the matrix, to be discussed and decided by the Board. The matrix was approved by the Board in January 2022. 

One of the items on the PPRTA 3 matrix was the creation of a “State and Federal Discretionary Grant Match Fund - Phase 1” program that could be used by any of the member governments. This program allows member governments to request approval by the Board to use the program for the local match funding requirements for projects on either the B-list or non-listed capital projects if the member government chooses to apply for a State or Federal discretionary grant. The local government making the request to use this program would be required to budget those funds from their planned PPRTA allocations.

The Board approved the inclusion of the of “State and Federal Discretionary Grant Match Fund - Phase 1” on the A-list, as a part of the 2022 ballot measure. Additionally, the Board requested approval by an affirmative vote of two-thirds (super majority) of the total number of votes assigned to the Board Directors present and voting if the program is used for B-list or non-listed capital projects.

In September 2024, it was recognized that the PPRTA Establishing IGA, Section 6.15 does not allow for super majority votes. It only allows for simple majority votes of those Board members present and voting. In October 2024, the CAC and Board recommended amending the Establishing IGA to require a super majority vote to approve projects under the “State and Federal Discretionary Grant Match Fund” program.

The proposed redlines to the Establishing IGA were minor and are provided for reference to highlight the changes. Most items remain unchanged from the previous version. The Establishing IGA has been reviewed by the City Attorney’s Office and the Public Works Department staff, and all find the proposed amendment acceptable.

Section 11 of Establishing IGA permits amendments to the Establishing IGA upon the unanimous consent of all member governments, and consent shall be manifested by a two-thirds affirmative vote of the membership of each governing body.
