Summary:
Resolution designating a City-owned (City) parcel in Colorado Springs as surplus and selling it to the one logical purchaser, James B. Klein (Klein,) who owns all adjacent properties. The sale will be at the appraised value, and necessary easements will be retained.
Background:
The City, on behalf of its Stormwater Enterprise (SWENT), is currently constructing roadway and stormwater improvements in the Park Vista South neighborhood (Project) generally located east of the intersection of North Academy Blvd and Austin Bluffs Pkwy (see location map). The Project improvements will address long-standing safety concerns and drainage issues throughout the neighborhood once controlled by El Paso County.
The property located at 1103 Lily Place, identified by El Paso County Tax Schedule No. 63262-08-002 (City Property), is considered surplus. The City acquired this parcel in 2023 via Quitclaim Deed from El Paso County as part of the Intergovernmental Agreement authorized by City Council under Resolution No. 18-23.
The City Property is 1 of 5 parcels forming a triangular block (see location map), with the remaining 4 parcels owned by Klein. Surrounded on 3 sides by Klein properties and bordered on the fourth side by the Templeton Gap Floodway channel along Lily Place, the parcel is effectively inaccessible to anyone other than Klein. The entire City Property is not needed for the Project, and necessary easements will be preserved.
The City previously purchased public improvement easements across the adjacent lots owned by Klein to facilitate the Project improvements to the Templeton Gap Floodway. The City will retain public improvement and utility easements across a portion of the City Property for drainage improvements to Templeton Gap Floodway and for an existing overhead power line. The retained easements cover about fifty percent (50%) the City Property.
The Resolution would declare the City Property as surplus and authorize its sale to James B. Klein, the one logical purchaser as defined in the Real Estate Manual, for the appraised fair market value of $24,500.
Previous Council Action:
On February 14, 2023, by Resolution No. 18-23, City Council approved the Intergovernmental Agreement between the City of Colorado Springs, Colorado and El Paso County, Colorado, regarding improvements to and future annexation of the Park Vista South area.
On December 10, 2024, by Resolution No. 191-24, City Council approved a land exchange between the City and Klein that in part included the City Property; however, Klein later declined to participate in the land exchange, and the parcels needed for the Project were purchased at the appraised value and no land exchange occurred.
Financial Implications:
Klein would purchase the City Property from the City for the Appraised Fair Market Value of $24,500 and those funds would be transferred to the City and its Stormwater Enterprise.

Stakeholder Process:
Klein has been in negotiations with the City involving the Project since 2023 including a previous land exchange involving the City Property that was later declined. Property owners throughout the neighborhood have been engaged by the City since 2023.
