The project includes a notification to City Council of the approval and recordation of a Certificate of Amendment to Plat Restriction removing an access limitation from Aeroplaza Drive for Lot 1 Block 1 of Gateway Subdivision Filing No. 7.

 

  Previous Council Action: 

In 1984, the Council approved the zoning of PBC (Planned Business Center), Ordinance Number 84-73.

 

  Background:

Pursuant to City Code Section 7.7.503(D)(1), the Planning & Community Development Department, in consultation with the Public Works Department and Colorado Springs Utilities, approved a Certificate of Amendment to Plat Restriction that removes an access limitation for Lot 1 Block 1 of Gateway Subdivision Filing No. 7. Subsequent to the approval, the Planning & Community Development Department recorded the certificate with the Records of the El Paso County Clerk and Recorder’s Office, a copy of which is attached.

City Code Section 7.7.503(D)(1) grants the authority to staff to administratively approve plat restrictions.  If approved, a report (resolution of the request) of the administrative approval is to be scheduled for the next Council meeting after the approval.  No action by Council is required.  This is simply a notification of the approval.

The property was annexed into the City in May 1971, per the Pikes Peak Addition #11 Annexation Plat. According to the current Gateway Master Plan, the property is identified as Commercial and was envisioned to be developed with commercial land uses. The site is currently vacant.

The Applicant requested the removal of a plat note that restricted access from Aeroplaza Drive and is still required to obtain access permits from City Traffic Engineering, as well as a coordinated effort with CDOT (Colorado Department of Transportation) for spacing requirements. The removal of the access restriction will improve the ingress and egress from the site and will lower commercial traffic on Jet Wing Drive. Jet Wing Drive is on the north side of this site and is adjoined by residential uses to the north and west. 

The project supports the City’s Strategic plan by providing a well-designed and functioning transportation system that respects all modes of transportation. As noted above, the access drive will improve vehicle circulation to and from the site once developed and passenger vehicle circulation in the immediate area.

The public process included postcards mailed to 261 property owners within 1,000 feet of the site during the internal review stage. The site was also posted. No comments were received during the public notice period.

Staff sent copies of the request to the standard internal and external review agencies for comments. Commenting agencies included: Colorado Springs Utilities, City Engineering, City Traffic, City Fire Prevention, and CONO. All comments received from the review agencies have been addressed.

No action is required. According to City Code Section 7.7.503(D)(1), City Planning Staff is providing notice of the approved Certificate of Amendment to a Plat Restriction.
