  Summary:

Colorado Springs Utilities and Southeastern Colorado Water Conservancy District (SECWCD) have memorialized their shared understanding of how contract provisions found in Bureau of Reclamation Contract No. 11XX6C0005 will be applied to all existing and future Regional Water Service Agreements Colorado Springs Utilities enters into. The Regional Intergovernmental Agreement with SECWCD records the terms under which Colorado Springs Utilities can serve regional water providers that are outside of the SECWCD boundary.

 

  Background: 

The Southeastern Colorado Water Conservancy District (SECWCD) manages the Fryingpan-Arkansas Project, which includes Pueblo Reservoir. Colorado Springs Utilities’ Southern Delivery System (SDS) connects to Pueblo Reservoir and is, in part, governed by Contract No. 11XX6C0005 with the U.S. Bureau of Reclamation. 
Colorado Springs Utilities has established a regional water service program that allows it to provide water treatment and conveyance services to entities both inside and outside SECWCD’s boundaries, using SDS infrastructure to deliver water to these Regional Entities. As Colorado Springs Utilities continues to enter such Regional Service Agreements, certain provisions of its federal contracts-particularly Contract No. 11XX6C0005-become relevant to how regional water deliveries are managed.
Colorado Springs Utilities and SECWCD have negotiated an intergovernmental agreement that formalizes their shared understanding of how these contract provisions apply to current and future Regional Service Agreements. The proposed agreement memorializes these terms and supports coordinated, compliant use of SDS infrastructure for regional water service.
Pending Utilities Board approval, the Intergovernmental Agreement will be presented at the May 26 City Council meeting.

On May 20, 2026, Utilities Board considered the proposed Intergovernmental Agreement with Southeastern Colorado Water Conservancy District for Regional Water Service Agreements to City Council for consideration at the regular City Council meeting on May 26, 2026.

 

  Stakeholder Process:

Southeastern Colorado Water Conservancy District approved the Intergovernmental Agreement at its April 16, 2026 meeting.

 

  Alternatives:

(1) Approve the resolution authorizing Colorado Springs Utilities to enter into the Agreement for Regional Waste Service; (2) not approve the resolution; (3) modify the resolution or the Agreement; or (4) refer the matter back to Colorado Springs Utilities for further consideration.
