  Summary:

The Peak Metropolitan District Nos. 4, 5, 6, and 7 (the “Districts”) was created under the City’s pre-2022 model service plan which has a maximum operations and maintenance mill levy of 10 mills.

 

This is a request to allow additional permitted operations and maintenance services listed in Exhibit D of the metropolitan district service plan. Currently, the description of services includes street and landscape maintenance, programming and management of park and recreation, security, operation, maintenance, and administration services. The proposed amendment proposes the addition of stormwater improvements to the services listed in Exhibit D of the service plan. There are no changes to maximum debt or operations, and maintenance mill levy with this amendment.

 

As such, this request is being reviewed as a limited amendment to the service plan.

 

  Background:

The Districts support a variety of non-residential uses associated with the Colorado Springs Airport Business Park. The Districts were organized pursuant to a Consolidated Service Plan approved by the City Council on July 26, 2022, by Resolution No. 103-22 (the “Original Service Plan”).

 

This First Amendment to the Consolidated Service Plan for Peak Metropolitan District Nos. 4, 5, 6, and 7 (the “First Amendment”) modifies the description of permitted services to be provided by the District identified in Exhibit D to the Original Service Plan to now include stormwater and drainage services (“Revised Exhibit D”). This amendment to the service plan will allow the metropolitan districts to cover the expenses for maintenance and repair of stormwater facilities associated with existing and future development within the Colorado Springs Airport Business Park.  This addition is in response to ongoing improvements being made to the Peak Innovation Park, where the needs for drainage improvements and potential acquisition of land for drainage improvements became known. Drainage services and improvements are a permitted service for Metropolitan Districts, but the previous service plan neglected to include this in the Exhibit D.

 

This proposed amendment was heard before City Council at Work Sesson on October 13, 2025.

 

 

  Financial Implications:

There are no direct implications to general City taxpayers and ratepayers outside of the boundaries of these applicable metropolitan districts.

The staff-level Special District Committee has been provided with the materials associated with this request.  As of the date of this staff report, there have been no comments or questions from the Committee on this request.
