Title

A Resolution Authorizing the Chief Executive Offer of Colorado Springs Utilities to Enter into an Agreement for Regional Wastewater Service Between Colorado Springs Utilities and Falcon Area Water and Wastewater Authority

  Presenter:

Bryan English, Development Projects Manager, Colorado Springs Utilities

Body

  Summary:

The Falcon Area Water and Wastewater Authority (FAWWA) is a Colorado statutory water and wastewater authority formed in 2017 to serve approximately 2,560 acres in unincorporated El Paso County, located northeast of Colorado Springs near Woodmen Road and Powers Boulevard. FAWWA provides wastewater collection service within its service area and receives wastewater treatment service from Colorado Springs Utilities for flows of up to 0.29 million gallons per day (MGD) under a May 2024 agreement. FAWWA has requested additional wastewater treatment capacity from Colorado Springs Utilities.

Colorado Springs Utilities has negotiated a regional Wastewater Treatment Agreement that would increase FAWWA’s maximum available wastewater treatment capacity from 0.29 MGD to 0.59 MGD. The additional capacity is intended to support continued development within FAWWA’s service area. The new agreement would replace the May 2024 agreement. The new agreement requires approval by City Council.

  Background:

City Code 12.5.304 allows Colorado Springs Utilities (“Utilities”) to provide by contract for the use of or connection to its wastewater system by institutions, plants, districts, governments, municipal corporations, or other similar users.

  Previous Council Action:

A previous agreement was executed in May 2024 with FAWWA for maximum available flows of up to 0.29 MGD.

This long-term (99-year) regional Wastewater Service Agreement is consistent with current regional policy and regional tariffs and will provide a positive revenue benefit to Colorado Springs Utilities’ customers.

  Financial Implications:

Gross revenue under the proposed agreement will be approximately an additional $580,000 per year.

  City Council Appointed Board/Commission/Committee Recommendation:

On October 21, 2026, the Utilities Board voted to move the proposed regional Wastewater Service Agreement with FAWWA to City Council for consideration at the Regular City Council Meeting on November 10, 2026.

  Stakeholder Process:

Colorado Springs Utilities staff worked with City Attorney’s Office - Utilities Division and FAWWA’s representatives to draft the proposed agreement.
