  Summary:

The owner of Lot 1 of Fox Rock Subdivision (“Property”), which is located outside City limits, has requested water service for the Property from Colorado Springs Utilities.  Colorado Springs Utilities requests that City Council approve the attached resolution authorizing the Mayor to execute the attached Agreement Providing Water Service to Land Located Outside of the City limits and Agreement to Annex for the Property, at the February 9, 2021City Council meeting.

 

  Background: 

Glenn Pressman (“Owner”) requests Colorado Springs Utilities’ water service for the Property, which is situated outside the City limits and is not currently eligible for annexation. City Code Section 7.6.210, Service without Annexation, allows the City Council in its legislative discretion to authorize water and wastewater service for properties located outside City limits that are not eligible for annexation. Colorado Springs Utilities’ staff and Owner have negotiated the attached Agreement Providing Water Service to Land located Outside of the City Limits and Agreement to Annex for the Property. Under the Agreement, Owner irrevocably consents to annex the Property to the City if requested and agrees to convey Owner’s interest in any water rights associated with the Property to the City. The Agreement limits development to single-family residential use and Owner agrees to comply with all codes, ordinances, rules, regulations and policies of the City including, but not limited to, the City's Subdivision Code, Building Code, Fire Code, Drainage Ordinance, Colorado Springs Utilities’ Line Extension Standards and Ordinances, Zoning Code and Landscape Code.

  Previous Council Action:

There has been no previous City Council action on this item. Though the City previously committed to provide water service to Fox Rock Subdivision.

 

  Financial Implications:

Owner will pay system Development Charges and service rates that are 50% higher than inside-City rates.

 

  City Council Appointed Board/Commission/Committee Recommendation:

The Utilities Board recommends approval of the attached resolution.

 

  Stakeholder Process:

City Planning Staff and Colorado Springs Utilities’ staff reviewed the application. They worked with the Owner to verify the Property qualifies for Outside City water service subject to agreeing to annex at a future date determined by the City.

 

  Alternatives:

Not approve the resolution.
