A request for Annexation of 19.884 acres, a Zone Change establishing R-Flex Medium/SS-O/AF-O (R-Flex Medium Scale with Streamside and United States Air Force Academy Overlays), and a Land Use Plan establishing Single-Family Residential use for up to 123 residential units located northeast of Kettle Creek Road and Old Ranch Road Intersection.

  Review Criteria: 

The below criteria from UDC outline the applicable codes associated with this project and each associated application. 

 

The review criteria for a Land Use Plan as set forth in UDC Section 7.5.514 are noted below.

 

1.                     Consistency with the Colorado Springs Comprehensive Plan and other plans and policies adopted by City Council;

2.                     Consistency with development standards the zone district in which the property is located, or would be located after a requested zone district change;

3.                     Compatibility with the land uses and development intensities surrounding the property;

4.                     Impacts of the permitted or requested uses, appropriate to the type of development, the neighborhood, and the community;

5.                     Adequacy of proposed ingress/egress points and traffic circulation, both on and off the site;

6.                     Capacity of the existing streets, utilities, parks, schools, and other public facilities to serve the proposed development;

7.                     Promotion of transitions in height, intensity, or character between proposed non-residential or mixed-use development and nearby low-density residential zone districts.

 

Staff finds the proposed application meets the review criteria for a Land Use Plan.

 

  Previous Council Action:

On June 10, 2025, City Council accepted the original petition for annexation. On May 26, 2026, City Council approved a resolution finding the Kettle Creek Addition No. 1 Annexation petition to be in substantial compliance with C.R.S. section 31-12-107, setting a public hearing date for July 14, 2026, to consider the annexation, and directing the City Clerk to provide notice of the hearing in accordance with C.R.S. section 31-12-108.

 

  Financial Implications:

The Fiscal Impact Analysis shows a positive cumulative cashflow for the City during the 10-year timeframe. The reason for this outcome is that the use tax revenue collected from residential construction early in the development is enough to maintain a positive result for the time-frame.

 

  City Council Appointed Board/Commission/Committee Recommendation:

City Planning Commission voted to approve the Kettle Creek Addition No. 1 Annexation, Zone Establishment, and Land Use Plan at the April 4, 2026, meeting (Vote 5-2-1) with Commissioner Robbins and Gigiano opposed due to the potential negative impact to existing neighborhoods based on existing public facilities, circulation, and proposed density.

 

Recommended Action

  Proposed Motions:

Should the City Council wish to approve the Kettle Creek Annexation Land Use Plan application, the following motion is suggested:

Approve the Kettle Creek Annexation Land Use Plan related to 19.88 acres based upon the findings that the request complies with the review criteria for Land Use Plan set forth in City Code Sections 7.5.514 and 7.5.516.

 

Should the City Council wish to deny the Kettle Creek Annexation Land Use Plan application, the following motion is suggested.

Deny the Kettle Creek Annexation Land Use Plan related to 19.88 acres based upon the findings that the request does not comply with the review criteria for Land Use Plan set forth in City Code Sections 7.5.514 and 7.5.516.
