Title
An Ordinance Amending Section 111 (Exclusivity) of Article 1 (General Provisions) of Chapter 12 (Utilities) of the Code of the City of Colorado Springs 2001, as Amended, Regarding Exclusivity of Utility Services
Presenter:
Tristan Gearhart, Chief Planning and Finance Officer, Colorado Springs Utilities
Scott Shirola, Pricing and Rates Manager, Colorado Springs Utilities
Body
Summary:
Colorado Springs Utilities (Utilities) requests approval of an Ordinance amending the Code of the City of Colorado Springs regarding exclusivity of service and the sizing of solar generating equipment.
Background:
At the September 22, 2026, City Council Regular Meeting, City Council approved modifications to Utilities' Electric Rate Schedules to increase the allowable system size of Renewable Energy Systems from 120% to 200% of the customer's average annual consumption of electricity as proposed in the July 2026 Net Metering Rate Case.
City Code § 12.1.111 (Exclusivity) currently limits sizing of retail distributed generation by consumers on their property to no more than 120%. Consistent with the approved changes to Utilities' Electric Rate Schedules, the proposed change would increase the limit to 200%, effective as of April 1, 2027. Both the existing limit and the proposed change meet the requirements of state statute (C.R.S. §§ 40-2-124).
Approval of this Ordinance will provide alignment of City Code exclusivity provisions with Utilities' Electric Rate Schedules.
