  Summary:

The Hancock Metropolitan District Nos. 1 and 2 are requesting amendments to the language in the consolidated service plan to bring certain topics in alignment with State Statute or to correct sections of the 2022 City Model Service Plan that are known by staff to have unintended consequences. The changes to these sections are minor and are being requested to better serve future bond issuances. This item was heard at City Council Work Session on October 13, 2025.

 

  Background:

The Hancock Metropolitan Districts Nos. 1 and 2 (herein “Districts) were created to support the development of a mixed-use community along the southeast corner of the future intersection of Chelton Road and Hancock Expressway. This District’s Initial District Boundary Map (Exhibit C-1) contains an area of approximately twenty (20) acres. The most recent amended and restated service plan (refer to Resolution 97-23), the District did not anticipate including any additional land and therefore did not provide a Future Inclusion Area Boundary Map (Exhibit C-2).

 

The Hancock Expressway currently runs through the Districts, but once realignment occurs, it will run along the northern District boundary line. As of now, no development has occurred within the Districts and no debt has been issued. Entitlements for the existing Districts boundary includes a concept plan approval for a mixture of single and two family residential, multi-family, and commercial uses. This concept plan approval is set to expire in approximately three (3) years (Ordinance 22-60), and there are still further planning applications and building permits needed before any development could take place. Regardless of the future land uses, the developers will be obligated to contribute to portions of the realignment, and this will make up a large responsibility for the Districts.

 

In anticipation of future bond issuances, the Petitioner is requesting several minor adjustments to the language of the consolidated service plan. These changes consist of the following sections:

1.                     V.A.12. : Council Debt Authorization Limitation

2.                     V.F : Eligible Bondholders

3.                     V.G.1: Maximum Debt Mill Levy

 

Changes made to the section on Council Det Authorization Limitation are intended to clarify that Section V.A.2 is the reigning statutory authority for debt authorization. This clarification reaffirms City Council’s role in the District’s debt authorization procedure by requiring that Council must weigh in on debt not previously authorized in Section V.A.2.

 

The additions made to Section V.F are intended to align the language in the service plan with that of Title 32 of Colorado State Statutes, which organizes and defines the roles of Metropolitan Districts. By adding this language, the service plan clarifies that certain types of eligible bondholders are eligible to participate in debt issuance activities. These types of entities were not previously defined in the Model Service Plan but are in alignment with Title 32 and are eligible to hold bonds issued by the District per State Statute.

 

The final alteration is to Section V.G.1 and pertains to the adjustments of debt mill levies. The request is aligning the Service Plan language with changes made to State Statute. Statute no longer requires these adjustments to be constitutionally approved, and instead now go through a simpler legislative process.

 

There were no other proposed changes to the service plan, including changes to the maximum mill levies, maximum debt authorization, or scope of permitted services. None of the exhibits of the service plan were altered with this proposed amendment. A separate, concurrent request to include an approximately seven (7) acres property to the north of Hancock Metropolitan District No. 1 has also been submitted by the Petitioner and will be heard simultaneously with the proposed service plan amendment.

 

While the subject request will not be impacted, it is worth noting that the existing District is within the Hancock Commons Urban Renewal Area (URA). The URA is aware of the proposed amendment to the service plan and inclusion of property into the District and there were no concerns raised about these items moving forward. URA representatives have confirmed that no actions will be required to amend the URA boundaries in response to this inclusion. Any efforts made by the URA related to this parcel will take place under separate actions and will not have any barring over the subject District requests.

 

 

  Financial Implications:

There are no direct implications to general City taxpayers and ratepayers outside of the boundaries of these applicable metropolitan districts.

The staff-level Special District Committee has been provided with the materials associated with this request.  As of the date of this staff report, there have been no comments or questions from the Committee on this request.

 

  Previous Council Action: 

City Council approved a consolidated service plan for the Hancock Metropolitan Districts Nos. 1 & 2 through Resolution 67-21 in May of 2021. Since that time, an amended and restated service plan was approved through Resolution 97-23 in July 2023 to bring the service plan into compliance with the City’s 2022 Model Service Plan.

 

  Alternatives:

City Council could choose to approve, deny or modify the proposed resolution.
