The minutes of the September 11, 2023 Work Session were approved by  
Consensus of City Council.

There was no Open Executive Session.

In accord with City Charter art. III, § 3-60(d) and its incorporated  
Colorado Open Meetings Act, C.R.S. § 24-6-402(4)(a), (b), and (e) and  
City Code § 1.5.506(B), the City Council, in Open Session, is to  
determine whether it will hold a Closed Executive Session. The issues to  
be discussed involve consultation with the City Attorney and staff for the  
purpose of receiving legal advice and determining positions relative to  
strategy and negotiation regarding (i) a litigation settlement in excess of  
$100,000, (ii) a purchase of land by the airport from CDOT, and (iii) a  
purchase of land by the airport from a private party.  
The President of Council shall poll the City Councilmembers, and, upon  
consent of two-thirds of the members present, may conduct a Closed  
Executive Session. In the event any City Councilmember is participating  
electronically or telephonically in the Closed Executive Session, each  
City Councilmember participating in the Closed Executive Session shall  
affirmatively state for the record that no other member of the public not  
authorized to participate in the Closed Executive Session is present or  
able to hear the matters discussed as part of the Closed Executive  
Session. If consent to the Closed Executive Session is not given, the  
item may be discussed in Open Session or withdrawn from  
consideration.

Wynetta Massey, City Attorney  
Ben Bolinger, Legislative Counsel, City Attorney’s Office, stated there were  
three Closed Sessions noticed for today’s meeting, but the purchase of  
land by the airport from a private party has been withdrawn.  
He stated that in accord with City Charter art. III, § 3-60(d) and its

Exponential Impact update on the impact of the Survive and Thrive and  
Accelerator programs  
Presenter:  
Vance Brown, Executive Director, Exponential Impact  
Vance Brown, Executive Director Exponential Impact (XI), provided an  
overview of EI, their Survive and Thrive program, accelerator program,  
mission, southern Colorado start-up week, acceleration program topics,  
participant testimonial, metrics, and impact. He identified the access to  
funding, timeline, Weidner Field Expansion, partners/contributors, and the  
XI team.  
President Helms asked if any businesses have requested assistance due  
to the power outage on Kiowa Street. Mr. Brown stated they will be eligible  
to apply for that in November/December.  
Councilmember Leinweber asked if they partner with the Pikes Peak Small  
Business Development Center. Mr. Brown confirmed they do as well as  
many others.  
Several Councilmembers expressed appreciation for what XI provides to  
the community and small businesses.

Ordinance No 23-57 Certifying Delinquent Stormwater Fees and  
Charges to the El Paso County Treasurer for Collection  
Presenter:  
Richard Mulledy, P.E., Stormwater Enterprise Manager

Richard Mulledy, Stormwater Enterprise Manager, presented the  
Ordinance certifying delinquent stormwater fees and charges to the El  
Paso County Treasurer for collection. He gave a brief summary of the  
delinquent stormwater fee collection process and stated there are 192  
parcels which are ninety days or more past due for a total of $81,697.01.

Ordinance 23-56 repealing Ordinance No. 23-46 and Approving a  
Supplemental Appropriation to the Memorial Health System Enterprise  
Fund in the amount of $1,465,848 for monies due to UCH-MHS for the  
periodic reconciliation with UC Health  
Presenter:

Attachments:  
Charae McDaniel, Chief Financial Officer, explained this Ordinance  
corrects the Ordinance 23-46 which had an error in it and approves a  
supplemental appropriation to the Memorial Health System Enterprise  
Fund in the amount of $1,465,848 in order to pay monies to the UCH-MHS  
as a result of a recent periodic reconciliation with the source of funds from  
the unrestricted fund balance.  
President Helms asked if the money had already been paid out. Ms.  
McDaniel stated it had not.

Councilmember Henjum stated she attended the Colorado Springs  
Chamber and EDC Washington D.C. Fly-In.  
Councilmember Risley stated he attended the annual breakfast held by the  
Downtown Partnership.  
Councilmember Avila stated she attended the Colorado Springs Chamber  
and EDC Washington D.C. Fly-In, Silver Key appreciation event, Food to  
Power event which is really important due to the Southeast King Soopers  
remaining closed.  
Councilmember Talarico stated she attended the Colorado Springs  
Chamber and EDC Washington D.C. Fly-In, Westside Community Center  
West Fest, Taste of Old Colorado City (OCC).  
Councilmember Leinweber stated he attended the Colorado Springs  
Chamber and EDC Washington D.C. Fly-In, Silver Key appreciation dinner,  
Home Front Military Network breakfast, and a suicide prevention event at  
America the Beautiful park.  
President Helms stated he attended the Home Front Military Network  
breakfast in which the guest speaker spoke about suicide and the  
community needs to address those issues and the mental health aspects  
associated with it, State of the City Address, Downtown Partnership  
breakfast, and encouraged everyone to attend the United States Air Force  
Academy football games.  
Councilmember Henjum encouraged people to visit the businesses which  
were impacted by the power outage on Kiowa Street.
